Waiver of Liability and Contract

for those seeking Membership in the Natural Fitness Trainers Association.

WHEREAS I am seeking Natural Fitness Trainers Association (hereafter referred to as the NFTA) Certification and as I have reviewed and understand this agreement, and also all of the information available at the NFTA website as of the date of my membership application, I voluntarily agree to the following:

The NFTA is in no way responsible for my actions or services as a Natural Success CoachTM, Natural Strength & Conditioning TrainerTM, Natural Sports TrainerTM, Natural Fitness TrainerTM, Master Fitness TrainerTM, or any other membership type. The NFTA is in no way responsible for my actions or services, in any capacity. I will indemnify and hold harmless the NFTA, all staff, employees, assignees, and anybody associated with the NFTA, for any (and all) injury, accident, loss or theft, or any dispute, that may arise between myself and the NFTA or with any client(s) I may service. I will require that all clients sign the client waiver of liability form that the NFTA requires. I will always maintain a copy of the waiver, and I will promptly provide a copy to the NFTA upon  its request.

The NFTA certification program and exam is the sole property of the NFTA. I will not reveal test questions, nor reveal the contents of the exam to anyone without prior written approval of the NFTA. I waive all rights to question the grading decision, and release the NFTA, and anyone associated with the NFTA from any liability associated with the certification exam, its grading procedures or methods. I understand that the NFTA does not give refunds and that the Terms and Conditions of this agreement and of NFTA membership are subject to change without notice.

I understand that NFTA Certification means that I must be committed to training "Drug Free", without the use of any legal or illegal bodybuilding enhancement type drugs, and that I am committed to "Natural" Fitness Training methods.  

I understand that I am required to obtain Cardio Pulmonary Resuscitation (CPR) certification - within 60 days of obtaining my NFTA Natural Strength & Conditioning TrainerTM, Natural Sports TrainerTM, or Natural Fitness TrainerTM Certification. I will mail a copy of my CPR certificate or card to the NFTA within the specified time limit. Also, if my CPR certification is not kept current, then my NFTA status may become probationary, or suspended until the NFTA receives said proof of my current CPR certification. Each year, I will mail the NFTA a copy of my current CPR certification.

I will maintain and observe the highest standards of professional conduct (honesty, courtesy, & dependability). I affirm that I have thoroughly studied and reviewed all of the information available at the NFTA website, and that I firmly believe in and approve of the NFTA methods, principles & guidelines, and likewise the methods, principles & guidelines contained in the "Members Area" and in the "No Nonsense Guide To Natural Bodybuilding" written by Frank Sheffield. I understand that these principles & guidelines are intended for use only by healthy and disease free individuals, age 18 and over.

Furthermore, I understand that the NFTA does not consider Natural Fitness Success Coach'sTM  qualified to act as independent health or fitness professionals, or as personal trainers. I understand and agree that if I am, at any time, employed or otherwise acting in said capacity, that I am required to obtain additional certification as a personal trainer or to be under the direct supervision of an experienced and qualified health professional.

Any correspondence from myself to the NFTA becomes the sole & exclusive property of the NFTA. I give the NFTA permission to provide my name, address, certification status, and educational status to prospective clients and to also post this information on their website, or for use in informational or promotional materials, or otherwise as deemed necessary.

I understand and agree that I will periodically (at least once per month) visit the NFTA website and Members area to keep up-to-date with any changes.

I will not take any actions which seek to discredit, dishonor, or cause any harm to the NFTA and/or its associates. I understand that the terms of this agreement are subject to change without notice, at the sole discretion of the NFTA. In the event that I am unhappy or dissatisfied (for any reason) with its service, its members, its affiliates, or its associates; the NFTA's liability will be limited to a refund of any fees paid, and as such, my sole remedy will be to seek a refund of fees that I have paid the NFTA. I understand that the NFTA does not give refunds. Furthermore, I understand that the NFTA conducts test proctor searches for U.S. residents only. I agree that by clicking on the submit button on the NFTA application page that I am legally bound by the terms of this agreement. That this agreement is to be treated as if I had I correctly signed, dated and completely filled out this form. I also understand that this agreement supersedes any other NFTA agreements or promises that may appear elsewhere.

Should I, or anyone, or any other entity, acting on my behalf, file a legal claim(s) against the NFTA, its owner, its employees, its members, its affiliates, or its associates, the said claim(s) must be filed in the jurisdiction of Athens/Clarke County, Athens, Georgia. Since filing a legal claim will constitute my breaking of this agreement, I promise to pay all associated legal and travel expense fees incurred for any and all of my opponents listed on said claim. Payment will be due upon demand. Furthermore, I will not file any legal claims(s) seeking a return or refund of this payment. These condition(s) will apply regardless of the outcome of said legal actions.

In the event that any part of this agreement is voided, the remaining portion(s) will remain in effect. The NFTA, all staff, employees, assignees, affiliates, or associates, will have the right to bring any dispute(s) to arbitration according to the rules of the Arbitration Association of their choice, whose decision will be considered final and legally binding.
